Tasmanians Target Ta Ann's Hamed Sepawi | Sarawak Report

Posted: 10 Mar 2012 10:21 AM PST

This post is also available in: Iban, Malay

Eco-Lies! Top Tasmania politician is shown up on TV News!

The highly effective campaign to prevent Taib's family company Ta Ann from destroying Tasmania, like Sarawak, is making Pinocchios out of politicians there!

Last week the state's Deputy Premier, Bryan Green, was subjected to national humiliation when he became the top story on Australia's ABC news for supporting the company's claims that its wood products are 'eco-friendly'. [Click here for photos and here for campaign blog]

The MP, who is one of a lobby supporting Ta Ann, had just come back from a trip to Japan trying to convince buyers that Ta Ann has not been lying over its claims that its wood had been sustainably sourced.

Pinocchio's photographic tour of Ta Ann's devastation in Tasmania will hold no surprises for the people of Sarawak!

This was in the face of a recent devastating report by local environmentalists, who have proved that, to the contrary, Ta Ann has broken its promises to use only plantation wood and has been getting cheaper wood by tearing down Tasmania's native, high conservation value forests.

Waiting for his luggage Green found himself trapped by a humorous cardboard cut-out of the long nosed Pinocchio, the favourite children's story character, whose nose grew with each lie he told. Ta Ann was written across the cutout's chest and TV cameras lined up to film Green's awkward moment!

Getting the message out! The Green Campaigners have exposed a political tie up with Ta Ann in Tasmania

The animals are getting worried

Hamed Sepawi - Growing questions in Tasmania

Campaigners have been increasingly questioning why local politicians like Green have been so vigorous in supporting Ta Ann's destructive behaviour?

After all the company, which is largely owned by Taib's cousin and nominee, multi-millionaire Hamed Sepawi, has produced a series of financial losses in the state.

Remarkably, these politicians have even threatened to destroy a vital Forest Agreement, currently underway with the Australian Federal government, which would pay the state hundreds of millions of dollars to protect its high conservation forest areas.

Ta Ann has been sourcing its wood from these areas and MPs like Bryan Green are demanding that unless the company is allowed to continue then they will pull out of the valuable agreement.

They have even attempted to blackmail Green campaigners, saying that if they don't stop exposing Ta Ann's misleading advertising then they will sabotage the Forest Agreement, worth so many millions to their own state!

Tasmanian Devil and Orang Utan - featured in a specially commissioned cartoon by Australian cartoonist Reg Monbassa.

So, as the animals are asking in this cartoon, showing the new comradeship between the endangered species of Borneo and Tasmania, both threatened by Taib, what is going on?

The Green Campaign scalps another 'Pinocchio'!

Not a holiday after all - the trip WAS paid for by Ta Ann and so was Mr Harriss's full board and extensive entertainment

Sarawak Report has already questioned a number of the links between some Tasmanian politicians and the Taib regime.

One of these was the Independent MP Paul Harriss, who had visited Kuching on three recent occasions, where he was presented as a representative of the Tasmanian Government.

Paul Harriss in turn told questioners back in Tasmania that in fact he had been on a 'holiday', despite being accompanied by Ta Ann Tasmania's Chief Executive, David Ridley, and despite his meetings with key Taib side-kicks Awang Tenggah and Len Talif.

However, this week it was revealed that Harriss did in fact register that the trip was paid for by Ta Ann! He has also admitted that he has received gifts worth thousands of dollars from the company.

The development has put the pro-Ta Ann politician's credibility at serious risk, as he attempts to lead the lobby to destroy the Forest Agreement. A series of newspaper articles reported that he has been forced to consult on whether he can continue to participate in votes and discussions about the Forest Agreement, given this clear conflict of interest, which he had failed to declare in previous debates!

[Harriss denies being bought by Ta Ann, Tasmanian Times, ABC, Greens question MP's Gifts ]

One more pro-Ta Ann Pinocchio has been outed this week in Tasmania!

Spotlight on Sepawi

Ta Ann supporter Simon Crean MP

And as the credibility of these Ta Ann lobbyists fast fades, more questions are being asked about those other politicians with links to Tasmania Hydro, which is currently chasing contracts in Taib's deeply controversial and destructive SCORE programme.

Sarawak Report has noted that another key Ta Ann campaigner, MP Simon Crean, is the brother of David Crean, Chairman of Hydro Tasmania. Hydro Tasmania is leading the construction of Murum and is chasing three of the next of Taib's dam mega-projects. The company is also in charge of monitoring the Bakun Dam as it starts to produce electricity.

Doing big business with Taib's Dirty Dam projects - brother David Crean shakes hands with Sepawi and Tenggah!

That electricity is designed to power a new Rio Tinto Alcan factory, which will cause the closure of the current factory in Tasmania, throwing thousands out of work!

So, again, what is the motive driving these politicians to undermine their own country's prosperity in favour of Taib and Ta Ann?

These questions have prompted a new study of Sepawi and his company Ta Ann, produced this week by environmental researchers in Tasmania.

The report "Ta Ann Destroying Rainforests and Violating Human Rights In Sarawak" provides a compelling insight for foreigners wanting to understand the problems in Sarawak and shows just how Taib manages the state, through a nexus of corruption run by his own family.

Detailed analysis of how Taib has run Sarawak for personal profit, through his key lynchpin Ta Ann's Hamed Sepawi

People in Sarawak should read it too. It explains how Taib put his cousin and nominee, and a handful of other key players, into all the key roles to create a single hub of political and economic control designed to enrich himself and his family.

Hamid has controlled Sarawak's key resources, first as Chairman of the Sarawak Timber Industry Development Council (in charge of logging), then as Chairman of the SEB (controlling the electricity and dam programme).

Notorious - Sepawi poses as a tree hugger!

Sepawi is also Chairman and major shareholder of the construction giant Naim Cendara (in receipt of major government contracts), Chairman and major shareholder of Ta Ann one of the largest plantation and logging companies (given huge lands by Taib), Chairman and major shareholder of Sarawak Plantation Bhd (in receipt of vast plantation licences). Crucially, he is also as Treasurer of PBB (putting him in charge of all the money in the chief political party). Then there are all the key associations representing people's interests that Sepawi is also Chairman of, such as the Oil Palm Plantation Owners Association. He is also Chairman of the Board of Sarawak Enterprise. The list continues.

In short, Sepawi has been one of the main instruments by which Taib Mahmud has grasped total political and economic control of Sarawak and poured it into the bank accounts of his own family. It has turned Sepawi into one of Asia's richest men.

Has his influence and control extended so far into Tasmania that Taib will succeed in destroying their forests in the same way as he has destroyed the forests of Borneo, Papua, Congo, Solomon Islands, Guyana and elsewhere?

If certain politicians in Tasmania have their way it would seem yes. But Pinocchio is watching their every move!

It's more than politics for several Parti Rakyat Sarawak leaders who've been found to have a finger in land deals in Sri Aman

Eleven longhouse chiefs representing their own 'anembiaks' (followers) have filed a suit against three companies, one owned by members of Parti Rakyat Sarawak (PRS).

The companies have allegedly encroached into their native customary rights land. The PRS president is James Masing, who is also the Land Development Minister.

The suit was filed last month by Messrs Baru Bian and Advocates at the Kuching High Court.

Named in the suit is Kriscore Sdn Bhd whose directors include Kristopher Nyuak Anak Bajok and Jessie Anak Hillary Chukan, both of them are members of PRS, and Razali Zainuddin.

The area licensed to Kriscore Sdn Bhd is about 3,281 hectares and is situated at Ulu Kesit, Lubok Antu.

Also being sued are YWP Industries Sdn Bhd, Pembinaan Suries Sdn Bhd, the Director of Forests, Superintendent of Lands and Surveys, Sri Aman and the Sarawak government.

Pembinaan Suries Sdn Bhd is licensed to extract timber on 850 hectares adjacent to the area given to Kriscore Sdn Bhd.
In their statements of claim, the natives want the court to declare that they had acquired and or inherited native title and native customary rights (NCR) over the area.

They want a declaration that this native title and rights preclude Pembinaan Suries Sdn Bhd (second defendant) and Kriscore Sdn Bhd (third defendant) from issuing or granting the said timber licences thereby impairing or abridging their native rights.

Govt breached Forests Ordinance

They also want a declaration that the acts of the director of Forest (fourth defendant) and the Superintendent of Lands and surveys, Sri Aman (fifth defendant) in issuing the said timber licences, in so far as they impair the natives' NCR over their pemakai menua or ancestral or NCR land, is wrong, illegal, unlawful, bad and void.

The landowners also want a declaration order that the issuance of the said timber licences to the Pembinaan Sdn Bhd and Kriscore Sdn Bhd overlaps or covers their pemakai menua, ancestral, or NCR land and as such is unlawful, improper, unconstitutional and therefore null and void.

They are also seeking an alternatively declaration that the issuance of the said timber licences is subject to the native title or native customary rights or usufructuary rights of the natives in or over the pemakai menua, or ancestral or NCR land.

They want the court to declare that in issuing and granting the timber licences, the Director of Forests and the Superintendent of Lands and Surveys, Sri Aman are in breach of their fiduciary duty to the natives and therefore the said timber licences were null and void.

They said the Director of Forests and the Superintendent of Land and Surveys, Sri Aman are in breach of the statutory provisions of the Forests Ordinance (Cap.126).

The natives want their NCR land be excised out of the area under the said timber licences and want a mandatory injunction against YWP industries Sdn Bhd (first defendant), Pembinaan Suries Sdn Bhd (second defendant) and Kriscore Sdn Bhd (third defendant) their contractors, subcontractors, employees, servants and workers from trespassing, clearing, using or occupying the plaintiffs pemakai menua.

They also claimed damages, exemplary damages, alternatively, aggravated damages, interests and costs.

The contested area is under state constituency of Batang Ai which is part of the Lubok Antu parliamentary constituency. The incumbent assemblyman of Batang Ai is Malcolm Mussen and the MP is William Nyalau, both are PRS senior leaders.

Nobel Badau: Berbelanja di Pasar Lubuk Antu

Posted: 14 Feb 2012 09:26 PM PST

Badau tgl.15 Pebuari 2012. Sarawak ministers in RM70mil kickback allegation « Hornbill ...

While the furore against Sarawak agriculture assistant minister Mong Dagang's instruction to cease welfare assistance to a disabled person is still boiling, whistleblower website Sarawak Report has raised another shocking allegation.

The website claims that Mong (left) and his party president James Masing are involved in RM70 million kickback from a land development scheme in Mong's constituency.

The allegation is based on a letter purportedly written by Mong on June 18, 1997, as the state assemblyperson of Bukit Begunan to Kho Chee Pheng of Megaruma Sdn Bhd, a company based in Kuching, asking for the kickback.

NONEIn the letter, first exposed in 2010 by a blogger, Mong allegedly authorised Kho to "propose, organise and invite any potential investor(s) intending to establish and to develop on a joint venture basis with the landowners of oil palm plantation in the Kelingkang Range, (Bukit Begunan), Sri Aman, Sarawak".

"I the undersigned hereby agree that the investor(s) will have to pay at least RM1,000 per acre and after deduction of the upfront to LCDA the balance will be divided 50 percent to the undersigned and 50 percent to Kho Chee Pheng," stated the letter.

The Land Custody and Development Authority (LCDA) is a state-owned statutory body to facilitate land development in Sarawak, especially native land.

Wives, brother, own nominee firm

The letter named three companies one of which was to be used for the joint venture, as well as three nominees to be registered with the company chosen for the enterprise.

The companies named are Noble Reserves Sdn Bhd, Noble Resources Sdn Bhd and Noble Rewards Sdn Bhd while the nominees are Bawang Ak Dem, Leyta Kupa and Henry Yan Masing.

The Sarawak Report claimed that Bawang is Mong's wife, Leyta is the wife of James' private secretary Wilson Ugak, and Henry is James' brother.

The website also published a document from the Companies Commission of Malaysia, showing the three nominees as major shareholders of Noble Reserves Sdn Bhd, one of the firms listed in the letter.

Should the payment of RM1,000 per acre come about, the total commission may go up to RM70 million as the letter stated that the plantation area was "approximately 70,000 acres" with investors having to pay "at least RM1,000 per acre".

Although the letter cannot be verified, Mong's purported signature on the letter is similar to the one shown on the letter to the Agriculture Department terminatingsubsidies to the disabled person, which Mong had admitted.

PKR Batu Lintang assemblyperson and native rights lawyer See Chee How told Malaysiakini that native landowners at the area, who had rejected the plantation scheme, are in the midst of bringing the case against the joint venture partners and LCDA to court.

The project was earlier pushed through by James and Mong on the basis that the local people would benefit, said See.

The Sarawak Report also quoted See as saying that both James and Mong had committed fraud because the duo had been trying to convince the people that they would be able to take a 30 percent share of the joint venture and share the profits in return for their land, but they were not told about the huge kickback.

"Under the joint venture that money should have been shared among the people, not paid to nominees of the very politicians who were talking them into the scheme," See added.

Both James and Mong were unavailable for comment at press time

MACC report against Masing and Mong | MoCS

KUCHING: The Sarawak PKR women's wing has lodged a report with the Malaysian Anti-Corruption Commission (MACC) against State Land Development Minister James Masing and State Assistant Agriculture Minister Mong Dagang for alleged misuse and abuse of power in a land deal in Sri Aman.

Masing is Parti Rakyat Sarawak (PRS) president while Dagang is a vice-president. Dagang is Bukit Begunan assemblyman.

Yesterday, a women's wing chief Nurhanim Mokshen handed over some documents, letters and reports in relation to the alleged land deal.

She called on MACC to investigate the allegation to take necessary actions to clear the names of the minister and the assistant minister or to commence the process of cleaning up "our public offices".

She was accompanied by a lawyer, Simon Siah.

The MACC told them that the commission was aware of the case and had been instructed to look into the matter.

Nurhanim's report was in response to online exposé by investigative portal Sarawak Report. The portal published a letter, allegedly signed by Dagang, asking for "kickbacks" amounting to RM70 million from the sale of 70,000 acres of land belonging to his own constituents.

The land at Kelingkang Range, Bukit Begunan, Sri Aman, was to be developed into an oil palm plantation.

Masing, Dagang's 'nominees'

In a letter dated June 18, 1997, Dagang allegedly asked for RM1,000 per acre from Megarume Sdn Bhd.

The letter also "directed" that "any of the three companies – Noble Reserves Sdn Bhd, Noble Resources Sdn Bhd or Noble Rewards Sdn Bhd – to be used for the joint venture with the "investors".

Dagang had also allegedly included details of his name and personal details and "also three photocopies of our nominees' identity cards".

The "nominees" listed in the letter were Dagang's wife, Bawang Ak Deru, Masing's personal secretary's wife, Leyta Kupa and Masing's brother Henry Yan.

All the three are directors of Noble Rewards.

The claim of alleged "kickbacks" came to light following a revelation that Dagang had revoked government welfare aid and subsidies to a disabled farmer simply because he had openly supported the opposition in last April's state election.

Masing's defence of Dagang merely added more fuel to the controversy, with Sarawakians angered over the former's advice to voters to "jangan lawan towkay" (alluding that they – Masing and Dagang –were the bosses and their decisions should not be challenged.

Case in court

Meanwhile, when contacted, native customary rights (NCR) land lawyer See Chee How confirmed that the area in question was already subject to a court case initiated by native landowners.

See, who is also the Batu Lintang assemblyman, said that more than 50% of the landowners had rejected the plantation and many had also turned down the paltry RM1,000 per family offered by these politicians.

Nevertheless, Masing and Dagang have as pushed through the project on the basis that the local people would benefit.

"It surely comes as a surprise that the native landowners are yet to receive any dividends from the enterprise after the first six years.

"This qualifies as fraud," See said, adding this is because Dagang and Masing had been trying to convince people they would be able to take a 30% share of the joint venture and share the profits in return for their land.

"They tell the people 'let the LCDA [Land Custody and Development Authority] develop your land and you will get 30% of the joint venture and profit. However, the people were not told about this huge kickbacks, " he said.

"Under the joint venture, the money should have been shared among the people, not paid to nominees of the very politicians who were talking them into the scheme," See said. – FMT
