Two activists are seeking hundreds of thousands in general, exemplary and aggravated damages for the trauma and shame inflicted on them by the Simunjan police.
All three are from the Simunjan police station
Numpang is also suing the police officers for malicious prosecution.
The government is also named as the third defendant in the suit.
Apart from the RM280,000 claim, the duo are also seeking general, exemplary and aggravated damages to be assessed by the court and interest thereon at the rate of 8% from Oct 22, 2010, to the date of judgment and thereafter at of 8% per annum to date of full payment and realisation.
They are also claiming damages, costs and other relief as the court deems just.
Numpang, from Kaumpung Bajong Ili, is a retiree, while Mujah who comes from Kampung Ensika, Sebangan, is the secretary-general of Sarawak Dayak Iban Association.
On or about Oct 20, 2010, Numpang was summoned to the Simunjan police station for a discussion.
Imprisoned for 'mischief by fire'
As he was having medical treatment in Kuching at that time, Numpang agreed to go to the Simunjan police station on Oct 22.
When he arrived at the police station, he was informed that he was being arrested on suspicion of causing 'mischief by fire' in connection with an incident that occurred at a logging camp owned by timber companies – Quality Concrete Sdn Bhd and Loyal Billion Sdn Bhd.
He was detained in the lock-up.
The next day (Oct 23) Numpang was taken before the district officer of Simunjan for a further remand and again sent to the lock-up. He remained imprisoned until he was released on Oct 25 at about 10.20am.
He was released without making any plea or any charge proffered against him. Nor was he ordered to appear before the magistrate.
Numpang claimed that his arrest and detention were without reasonable or probable cause and therefore illegal.
He alleged that his arrest and detention were tainted with malice.
Numpang was never charged with "mischief by fire" as was informed by Choo.

No valid reason
Choo or his officers did not have any discussion with Mumpang or failed to interview him.
Instead he was put in the lock-up without any valid reasons or grounds or reasonable or probable cause.
Numpang said he had suffered shame and damages as a result of the illegal arrest and detention or false imprisonment and was traumatised by his experience.
On the malicious prosecution against him, Numpang was asked to appear before a magistrate's court in Serian on Dec 15, 2010, and was charged by the public prosecutor with "criminal intimidation".
He had allegedly uttered intimidating words to the representatives of the timber companies on Oct 18 at the logging camp in Rantau, Sebangan.
The case was heard before the magistrate's court in Simunjan on Feb 16, 2011.
On March 10, 2011 the magistrate ruled that the public prosecutor had failed to establish any prima facie case against him.
Numpang was discharged and acquitted.
Similar charges
The public prosecutor appealed but after a number of postponements, the prosecutor withdrew the case.
As for Mujah, he was also summoned to the police station on Oct 22 for a discussion.
When Mijah presented himself on Oct 23, he was arrested also on suspicion of causing "mischief by fire" in connection with the fire that occurred at the logging camp of the two companies at Sebuyau, Sebangan.
He was detained in a lock-up and released on Oct 25 without any charge proffered against him nor was he ordered to appear before the magistrate.
Mujah claimed that he had suffered shame, damages and was traumatised as a result of the illegal arrest and detention.

Pesta Benak 2012 yang bermula hari ini hingga Ahad di sini, hari ini.
Benak berlaku setiap hari pada berbeza waktu apabila air pasang besar dari muara Batang Lupar menghala ke hulu kira-kira sejauh 120 kilometer dengan kelajuan kira-kira 30 km/jam. Pesta ini diadakan setiap tahun yang dimasukkan dalam kalendar pelancongan negeri ini sekaligus menjadikan fenomena ini sebagai tarikan utama pengunjung ke bandar itu khasnya dan negeri Sarawak umumnya.

Saya pasti anda semua pernah mendengar tentang meluncur ombak laut (sea surfing),tetapi saya yakin bahawa anda semua belum pernah lagi mendengar tentang meluncur ombak sungai (river surfing) dan saya juga percaya bahawa keunikan sukan yang amat menakjubkan ini hanya boleh didapati di Sarawak sahaja melalui festival tahunan iaitu Pesta Benak.

Benak juga dikenali sebagai "Tidal Bore", Benak berlaku pada setiap hari dengan jarak gelombang dan ketinggian ombak yang berbeza.

Bagaimanapun,sepanjang masa air pasang besar,ia boleh diperhatikan dengan jelas dan pada masa inilah luncur ombak sungai menjadi realiti.

Seperti yang kita tahu,hanya lima tempat di seluruh Asia yang mengalami kejadian Benak ini.Dan Sri Aman pasti akan menjanjikan kepuasan untuk melihat ombak yang terbaik.

Ia akan menjadi festival tahunan yang akan diadakan pada setiap tahun dan boleh menjadi destinasi perlancongan yang teramat mengujakan.

Jadi saya sarankan tuan-tuan dan puan-puan pergi ke Bandar Sri Aman untuk merasai sendiri keunikkan Pesta Beenak pada tahun ini yang mungkin akan menjanjikan kepuasan terhadap tuan-tuan dan puan-puan,ia sejajar dengan temanya Sri Aman Bandar Benak.

TEMAN SETIA: Ya Ustazah...

Salam.
pertemuan kembali di halaman coretan kisah perjalanan hidup yang semakin hari semakin mencabar diriku untuk menjadi lebih matang dan berdedikasi dalam semua lapangan yang diaturkan.
Assalammualaikum....Ya Ustazah!!! gelaran yang baru beberapa bulan aku cabuti kini ianya kembali melekat ke dalam diriku...tidak perlu berlari jauh atau mencari ruangan yang lain ia tetap akan mengejarku...terimalah kenyataan dirimu seorang Ustazah. Ustazah yang jika disemak di dalam tulisan kamus membawa maksud seseorang yang mengajar ilmu agama.
ya aku sekarang seorang ustazah di SK Sematan, daerah Lundu, Sarawak. masih di bawah title "guru pelatih" masih mencari ilmu teori dan pratikal dalam mendalami tugas sebagai ustazah.
Aku mengajar untuk matapelajaran "Pendidikan Islam".
sebenarnya J-QAF ini diwujudkan adalah untuk membantu guru Pendidikan Islam yang sedia ada untuk mengajar murid-murid yang mengalami masalah dalam pembelajaran pendidikan Islam khususnya Al-Quran dan penulisan Jawi. Dalam erti kata lain "murid-murid yang berada dalam kelas pemulihan. jadi kerja sebagai guru J-QAF ini tidaklah seberat kerja guru matapelajaran yang lain terutamanya guru-guru UPSR yang mana ujian penilaian ini menjadi kayu pengukur kejayaan akademik bagi sesebuah sekolah itu.
walaubagaimanapun, ketahuilah bahawa tanggunggajawab ini sebenarnya lebih berat dari segala-galanya kerana ianya adalah besi pengukur kecemerlangan seseorang di dunia dan juga di akhirat.terima kasih dan jutaan penghargaan diberikan kepada Perdana Menteri sebelum Yb.Najib yang telah mencetuskan idea penubuhan J-QAF ini.(Pak lah)
Kisah di bumi Kenyalang ini.
Sejujurnya aku belum lagi berkesempatan untuk memijak bandar yang mempunyai empat ekor patung kucing yang comel itu lagi. bukan kerana tidak menginginkannya namun disebabkan faktor kewangan dan status aku sebagai "pelajar & pekerja" di sini membuatkan aku berasakan tidak mengapalah...bersabarlah...nanti insyaAllah, bukan sekadar memijak untuk berjalan tetapi berlari-lari juga..hanya di Satok & Lundu sahaja aku sempat berjalan dan bershopping selain pekan sematan yang boleh dikatakan hari-hari aku bershopping dan window shopping selalunya..
inilah kisah dua bulan di bumi sarawak ini...InsyaAllah akan menyusul kelak yang lain...
cantik bakul makanan tu kan!!di Semenanjung kita biasanya buat bakul mandi..nanti nak bawak baldi la..nak letak bekas makanan hehehehe cikgu mesti lebih dari anak murid kan...

Tempat asal Lubuk Antu, kini dijadikan taman rekreasi.

CATATAN PERJALANAN: Kalimantan siri 19

LUBUK Antu, mengapa dinamakan Lubok Antu? Dikatakan wujud kerana dulunya di kawasan-kawasan Ulu Sungai Batang Ai, sering berlaku peperangan di kalangan masyarakat Iban. Sehingga mayat-mayat bergelimpangan dibuang atau terjatuh kedalam sungai, dihanyutkan oleh arus deras dan terkumpul di suatu lubuk hilir Sungai Batang Ai.

Mayat-mayat telah tersekat dan tersadai di lubuk itu tanpa sesiapapun yang berani menguruskannya. Kerana itu penduduk tempatan beranggapan bahawa kawasan atau lubuk itu telah menjadi 'keras' berpuaka atau 'berhantu'. Maka lahirlah nama Lubok Antu.

Kini, tempat berkenaan telah diperindahkan dengan lanskap taman rekreasi yang menarik oleh pihak Majlis Daerah Lubok Antu. Kedudukannya, memang berhampiran dengan Pejabat Daerah Lubok Antu dan agensi-sgensi Kerjaan lain seperti Jabatan Kastam & Eksais diRaja dan Imigrisen.


Itu cerita versi pertama. Versi kedua, begini...

Diceritakan, suatu ketika dahulu ada dua orang adik-beradik bernama Chiri dan Jampi. Suatu hari, mereka pergi untuk 'Ngamboh' parang (nempek parang). Semasa balik dari ngamboh, mereka telah tersermpak dengan 'Bunga Nuing' (Orang Panggau atau Kayangan). Bunga Nuing telah mencabar mereka berdua untuk beradu ketajaman parang.

Dalam peraduan itu Bunga Nuing telah 'mansap' (menetak) batu yang terdapat di tepi sebuah lubuk. Semenjak peristiwa itu, daerah ini secara keseluruhan telah dikenali sebagai Lubok Antu kerana Bunga Nuing yang menetak batu tersebut bukanlah golongan manusia biasa. Masyarakat tempatan pada masa itu pun beranggapan bahawa lubuk tersebut ada hantu atau berhantu. Jadilah Lubuk Antu. Di negeri Sarawak Malaysia.

Pasar kraf menjual pakaian tradisional orang Iban.



Sekarang aku berada di sebuah komplek dekat terminal bas di pekan Lubuk Antu lepas keluar dari jalan tikus Badau tanpa apa-apa halangan. Al-hamdulillah. Aku dengan pemandu motosikal yang membawaku singgah minum di sebuah kedai makan orang Iban di situ.

"Tuan dari datang dari Badau berubat ke?" Sapa taukeh kedai itu dengan peramah. Mungkin kerana dia melihat aku terhencot-hencot tanda sakit.

Aku mengangguk, "Hampir berubat..." Kami saling memperkenalkan diri dan menjadi sahabat.. Kini dia sahabatku dari kaum Iban.

Orang Iban juga adalah dari suku Dayak.

Kalau kita lihat sejarah, secara umum kebanyakan penduduk kepulauan Nusantara adalah penutur bahasa Austronesia. Saat ini teori dominan adalah yang dikemukakan linguis seperti Peter Bellwood dan Blust, iaitu tempat asal bahasa Austronesia adalah Taiwan. Sekitar 4, 000 tahun lalu, sekelompok orang Austronesia mulai berhijrah ke Filipina. Kira-kira 500 tahun kemudian, ada kelompok yang mulai berhijrah ke selatan menuju kepulauan Indonesia sekarang, dan ke timur menuju Pasifik.

Namun orang Austronesia ini bukan penghuni pertama pulau Borneo. Antara 60,000 dan 70,000 tahun lalu, waktu permukaan laut 120 atau 150 meter lebih rendah dari sekarang, waktu itu kepulauan Indonesia berupa daratan (para geolog menyebut daratan ini "Sunda"). Manusia sempat berhijrah dari benua Asia menuju ke selatan dan sempat mencapai benua Australia yang tidak terlalu jauh dari daratan Asia, masa itu.

Dari pegunungan itulah berasal sungai-sungai besar seluruh Kalimantan. Diperkirakan, dalam rentang waktu yang lama, mereka menyebar menelusuri sungai-sungai hingga ke hilir dan kemudian mendiami pesisir pulau Kalimantan. Di daerah selatan Kalimantan Suku Dayak pernah membangun sebuah kerajaan. Dalam tradisi lisan Dayak di daerah itu sering disebut Nansarunai Usak Jawa. Kerajaan Nansarunai dari Dayak Maanyan telah dihancurkan oleh Majapahit, terjadi antara tahun 1309-1389.

Kejadian tersebut mengakibatkan suku Dayak Maanyan terdesak dan terpencar.. sebahagian masuk daerah pedalaman ke wilayah suku Dayak Lawangan. Arus besar berikutnya terjadi pada masa pengaruh Islam berasal dari kerajaan Demak bersama masuknya para pedagang Melayu (sekitar tahun 1520).

Sebanaku <b>Sarawak</b>: DENGAN LAFAZ IKRAR, TUANKU ABDUL <b>...</b>

KUALA LUMPUR: Dengan sempurnanya lafaz ikrar sebagai Ketua Negara, Tuanku Abdul Halim Mu'azam Shah, 84, selamat ditabal sebagai Yang di-Pertuan Agong Ke-14 dalam satu upacara penuh istiadat kebesaran Raja-Raja Melayu, di Istana Negara, di sini, hari ini.

Sebaik selesai kemuncak Istiadat Pertabalan itu, tiupan nafiri dan paluan nobat dengan lagu "Perang" bergema di Balairong Seri, dan para hadirin berdiri dan melaungkan "Daulat Tuanku" sebanyak tiga kali, diketuai oleh pemangku Datuk Maharaja Lela Azwan Effendy Zairakithnaini.

Serentak itu juga, tembakan meriam sebanyak 21 das dilepaskan dan lagu "Negaraku" dimainkan oleh Pancaragam Pusat Tentera Udara Diraja Malaysia, diketuai Left Sabri Abdullah.

Istiadat Pertabalan yang berlangsung penuh berwarna-warni itu disaksikan kira-kira 900 orang tetamu termasuk Raja-Raja Melayu dan Permaisuri masing-masing, wakil-wakil Raja-Raja Melayu, Gabenor-Gabenor, Yang Di-Pertua-Yang Di-Pertua Negeri, Perdana Menteri, Menteri-menteri Kabinet dan isteri masing-masing. 

Turut menyaksikan acara gemilang itu ialah tetamu-tetamu kehormat yang terdiri dari ketua-ketua Diplomat asing dan ketua-ketua jabatan kerajaan lainnya.

Upacara hari ini mengandungi dua sejarah penting bagi Seri Paduka kerana ini kali kedua baginda ditabalkan sebagai Yang di-Pertuan Agong selain merupakan Yang di-Pertuan Agong pertama yang ditabalkan di Istana Negara baru di Jalan Duta. 

Tuanku Abdul Halim dilantik sebagai Yang di-Pertuan Agong Kelima pada 1970 semasa berusia 42 tahun, dan kini empat dekad kemudian, baginda ditabalkan sekali lagi sebagai Yang di-Pertuan Agong ke-14 pada usia 84. 
Menambah keunikan pertabalan kali ini ialah Perdana Menterinya, Datuk Seri Najib Razak, di mana semasa Tuanku Abdul Halim ditabalkan sebagai Yang di-Pertuan Agong Kelima, perdana menteri pada masa itu adalah ayahanda Najib, Allahyarham Tun Abdul Razak Hussain, iaitu perdana menteri kedua negara.

Istiadat Pertabalan Yang di-Pertuan Agong Tuanku Abdul Halim dan Raja Permaisuri Agong Tuanku Hajah Haminah disiar secara langsung oleh Radio Televisyen Malaysia (RTM).

Istiadat Pertabalan dimulakan sebaik keberangkatan masuk Tuanku Abdul Halim dan Tuanku Hajah Haminah ke Balairong Seri dengan diiringi tiupan nafiri dan paluan nobat lagu "Belayar" oleh Kumpulan Nobat Diraja Kedah. 

Keberangkatan masuk pasangan Diraja itu didahului pemangku Datuk Maharaja Lela Azwan Effendy Zairakithnaini, serta diapit panglima-panglima yang membawa Cogan Alam dan Cogan Agama.

Cogan Alam dan Cogan Agama, kedua-duanya tongkat perak yang merupakan sebahagian alat kebesaran Diraja yang menjadi lambang kebesaran Kerajaan Malaysia. 

Tuanku Abdul Halim berpakaian rasmi Yang di-Pertuan Agong iaitu muskat (seperti kot hitam labuh) yang bersulam emas serta berseluar panjang bersulam di kaki dengan bertengkolok "Dendam Tak Sudah". 

Baginda juga memakai Pending Diraja, diperbuat daripada emas bertatahkan permata delima dengan lambang Kerajaan Persekutuan tertera di tengah-tengahnya bersama-sama tali bengkung yang diperbuat daripada kain sakhlat bertekat benang emas berbunga-bunga. 

Di pinggang Seri Paduka tersemat Keris Pendek Diraja yang hulunya diperbuat daripada mata keris lama dengan bersarung gading bertatahkan emas. 

Tuanku Hajah Haminah pula memakai perhiasan Raja Permaisuri Agong iaitu Gendik Diraja yang merupakan pakaian ulu (kepala) dan Kalung Diraja, kedua-duanya diperbuat daripada emas putih bertatah berlian dan mengenakan persalinan baju panjang sedondon.

Seri Paduka berdua kemudiannya bersemayam di Singgahsana untuk Istiadat Pertabalan. 

Istiadat diteruskan dengan membawa masuk baki alatan kebesaran yang diketuai oleh pemangku Datuk Maharaja Lela bersama Datuk Pengelola Bijaya Diraja Datuk Awang Kechik Abdul Rahman membawa masuk senaskhah al-Quran, Keris Panjang Diraja yang juga Keris Kerajaan, Surat Pengisytiharan dan Warkah Ikrar dibawa oleh pegawai-pegawai Istana Negara, diikuti Pegawai Agama Istana Negara Datuk Abd Aziz Che Yacob dengan diiringi paluan nobat dengan lagu "Palu".

Nashkah al-Quran, sebagai lambang kemuliaan Islam sebagai agama rasmi negara, kemudiannya disembahkan kepada Seri Paduka oleh pemangku Datuk Paduka Maharaja Lela. 

Baginda lalu mencium al-Quran dan meletakkannya di atas rehal yang terletak di atas meja tengah di antara Seri Paduka berdua. 

Pemangku Datuk Maharaja Lela kemudiannya menyampaikan surat pengisytiharan pertabalan kepada Najib yang tampil ke hadapan Singgahsana, mengangkat sembah dan membacakan perisytiharan itu. 

Ini diikuti dengan Pemangku Datuk Paduka Maharaja Lela mempersembahkan Keris Kerajaan sebgai alat kebesaran utama negara kepada Yang di-Pertuan Agong.

Seri Paduka yang menerima keris berkenaan lalu dihunus, dan dikucup sebelum menyarungkan semula keris itu sebagai simbolik kebesaran dan kekuasaan kepada Seri Paduka.

Keris itu kemudian diletakkan Seri Paduka di atas meja di hadapan nashkah Al-Quran.

Seri Paduka kemudiannya melafazkan ikrar sebagai Yang di-Pertuan Agong untuk menjalankan pemerintahan seadil-adilnya bagi Malaysia, mengikut undang-undang dan Perlembagaan Negara serta memelihara dengan sempurna agama Islam dan berdiri teguh di atas pemerintahan yang adil dan aman. 

Sebaik sahaja selesai warkah ikrar dilafazkan, nafiri ditiup dan lagu nobat "Perang" dimainkan, diikuti laungan "Daulat Tuanku" sebanyak tiga kali oleh pemangku Datuk Paduka Maharaja Lela diikuti hadirin di dalam Balairong Seri, serentak dengan tembakan meriam sebanyak 21 das dilepaskan dan lagu "Negaraku" dimainkan. 

Perdana Menteri kemudiannya sekali lagi menghadap sebagai mewakili kerajaan dan rakyat mempersembahkan Ucapan Tahniah dan Taat Setia atas pertabalan baginda, diikuti dengan Tuanku Abdul Halim menyampaikan Titah Diraja. 

Pegawai Agama Istana Negara Datuk Abd Aziz Che Yacob kemudian membacakan doa selamat. 

Selepas itu, pahar berisi al-Quran dibawa turun dari Singgahsana oleh pemangku Datuk Paduka Maharaja Lela sebelum menyembahkan bahawa Istiadat Pertabalan Seri Paduka Baginda Yang di-Pertuan Agong ke-14 selamat disempurnakan. 

Seterusnya, Balairong Seri bergema sekali lagi dengan tiupan nafiri dan paluan nobat yang memainkan lagu "Belayar" mengiringi Seri Paduka berdua meninggalkan istiadat dengan didahului pemangku Datuk Paduka Maharaja Lela dan Datuk Pengelola Bijaya Diraja dan panglima-panglima yang membawa alat-alat Kebesaran Diraja.

Tuanku Abdul Halim dipilih sebagai Yang di-Pertuan Agong ke-14 oleh Raja-Raja Melayu pada Mesyuarat Khas Majlis Raja-Raja kali ke-226 pada 14 Oktober 2011 bagi menggantikan Tuanku Mizan Zainal Abidin Ibni Almarhum Sultan Mahmud Al-Muktafi Billah Shah yang tamat tempoh pemerintahannya pada 12 Disember 2011. 

Pada tanggal 13 Disember 2011, sempena Mesyuarat Khas Majlis Raja-Raja kali ke-227, Tuanku Abdul Halim dengan rasminya diisytiharkan sebagai Yang di-Pertuan Agong bagi memerintah negara buat kali yang kedua. - BERNAMA

Documents leaked from a Malaysian Anti Corruption Commission (MACC) enquiry have provided devastating evidence of the Sabah Chief Minister, Musa Aman's, personal involvement in a massive timber kickback scandal, which insiders say has been subject to a high level political cover-up.

Aman has always denied that he was linked to allegations surrounding the Sabah timber trader Michael Chia, who was arrested in Hong Kong and charged with money laundering, as he attempted to smuggle SG$16million in bank notes back to Malaysia in 2008.

However, Sarawak Report has now obtained access to secret documents from the investigations by Hong Kong's Independent Commission Against Corruption (ICAC) and Malaysia's MACC, which directly implicate the Chief Minister.

These include copies of bank statements, which record payments to Musa Aman's own sons from suspect accounts linked to Chia's business activities.

Chia was Musa Aman's 'adopted son'

Michael Chia, who referred to himself as Aman's adopted son, played the role as facilitator for kickbacks to the Chief Minister, according to trade insiders.

They say that soon after Aman took office, Chia started approaching key timber industry players to make plain that major concessions would be available – but only if kickbacks were paid, through him as the connector to Musa Aman.

"Tampokong was instructed to follow Chia's instructions", say sources. Meaning that Yayasan Sabah's Forest Manager, Mohd Daud Tampokong, had been instructed by the Chairman of the Board Trustees, Musa Aman, to do Chia's bidding when it came to authorising logging licences.

Yayasan Sabah controls around a million hectares of remaining forest land, which it is suppose to protect and manage on behalf of the state and its people.  Unwisely, the country's top politician is also the head of Yayasan's Board of Trustees, giving the Chief Minister unlimited personal control over the country's major natural resource.

Such a lack of check and balances is a recipe for corruption and our evidence shows that Aman took spectacular advantage.

 Smoking gun bank accounts

Dandy - Chia loved the fast life. According to one friend "he would spend $2k on his underwear"!

At the time of his arrest in Hong Kong, clutching the bundle of Singapore bank notes worth SG$10,000 each, Chia was suspected of smuggling dirty money, with the intention of bringing it back to Sabah to finance election bribery by BN.

The money and related bank accounts were frozen in Hong Kong by the Independent Commission Against Corruption (ICAC) for the maximum period of 3 years, while investigators sought to get vital cooperation from Malaysia's Attorney General, Abdul Gani Patail, in order to be able to get the evidence they needed from the Malay authorities.

Simultaneously the MACC began their own investigation, seizing 9 lorry loads of material and documents from the premises of Michael Chia and his timber business associates, including timber magnates Andrew Lim and Admond Looh.

The investigators discovered that Chia had been running a number of related bank accounts through HSBC, Singapore and the Swiss Bank UBS, based in Hong Kong. We have copies of statements from these bank accounts showing that the sons of Musa Aman were taking money out of one of them on a regular basis, based on a standing instruction.

This account was set up as an Australian Dollar account in Singapore, apparently because the boys were then studying in Perth, Australia.  Money was also removed from the account by Imbarine Bujang, who was the man delegated by Musa Aman to take care of the boys' needs while away at University in Perth.

How can Musa deny his link to Chia's activities when his own sons were taking money out of accounts that were being managed by Chia and his associates?

Mohammed Hayssam Musa and Hazem Mubarak Musa are both offspring of the Chief Minister.  Sarawak Report has numerous copies of statements from this bank account, showing that their expenses were being regularly paid from it during 2006 and 2007.

A payment was also made to the Australian property company, Riverstar Investment Pty Ltd, to cover the rental costs of the boys' apartment in Perth.

Payment for the rental for Musa's sons in Australia also came out of the same account controlled by Chia

Statements in our possession from connected USD$ accounts with the same UBS Hong Kong bank (managed through the Singapore branch) show how money was transferred to cover the payments. Our evidence is that the money flowing into these accounts was directly linked to the granting of major timber licences by Yayasan Sabah.

Chia himself paid directly to Musa's boys

Any attempt by the Chief Minister to distance himself and his family from the evidence that he has been receiving money through Michael Chia is made even less convincing by the fact that other bank statements, made available to the MACC enquiry, show that Chia himself had been covering these regular payments to the boys in the period before setting up the UBS account in 2006.

These payments were made through his personal HSBC account!

SG 85,000 payment to Mohammed Tampokong!

The leaked documents in our possession also show that Yayasan Sabah's Forest Manager, Mohd Daud Tampokong (instructed to cooperate with Chia) also received an enormous payment from another related account run by Chia and his associates, this time from a company based in the British Virgin Islands, Zenique Investments Ltd.

We question on what grounds the salaried civil servant in charge of managing Sabah's timber concessions could legitimately accept a SD85,000 payments from an offshore British Virgin Island account?

Explanation needed? Why did Sabah's Forest Manager receive a SG85,000 payment from a BVI account in November 2006?

This evidence strongly corroborates allegations that Michael Chia was receiving kickbacks from timber companies receiving concessions from Yayasan Sabah, which had been authorised by Mohd Daud Tampokong, and that Chia was then forwarding money from his web of bank accounts to Musa and to the Forest Manager.

Musa Aman has till now distanced himself from this kickback investigation, in which case he needs to come up with convincing explanations about these payments.

Cover up

Protecting his powerful family and political allies? Attorney General Abdul Gani Patail

So far, the Chief Minister has been protected from prosecution, according to our sources, by the deliberate obstruction of the official investigation by Malaysia's top law enforcement authority, the Attorney General.

Abdul Gani Patail is a fellow Sabahan and has close family connections with the Aman family and he has blocked the pressing of all charges.

We have learnt that the Hong Kong Anti-Corruption Commission investigators initially approached the Malaysian authorities in 2008 with a request for assistance in pursuing their enquiries after Michael Chia's arrest.

However, the Attorney General refused to sign the necessary mutual legal assistance documents to enable inter-country cooperation on the case. We understand that Gani even went to Hong Kong seeking to negotiate with his opposite number there to close the case.

After 3 years the Hong Kong authorities were forced by statutory limitations to unfreeze the Chia accounts and shelve the investigation owing to Malaysia's refusal to cooperate.  The millions of dollars in these accounts were released towards the end of last year and it is believed a great deal of the money will be channelled into Sabah, in order to attempt to buy votes for UMNO/BN in the coming federal election.

MACC investigation was also blocked by Gani

A parallel MACC investigation, which unearthed huge amounts of information about Sabah timber kickbacks, has also been blocked.

The Malaysian investigators, who are understood to have been extremely thorough, took evidence from numerous business associates of Chia and timber traders, who admitted to paying kickbacks.  The MACC is believed to have recommended that no less than 40 charges be brought against Sabah's Chief Minister and yet once again the Attorney General has refused to recommend a prosecution of the case.

"The report with all the evidence is still sitting on his desk", one source has told us.

This situation supports the clear frustration expressed publicly just last week by the MACC Deputy Commissioner, Mohd Shukri Abdull, who admitted that the Attorney-General has refused to bring many "valid cases", claiming lack of evidence.

Sarawak Report has now received much of that evidence and over the coming days we will be sharing it with the public and inviting people to make their own judgement on the case which Malaysia's Attorney General is refusing to bring to court.
