Villagers sue Masing's men « Hornbill Unleashed

Posted: 11 Mar 2012 09:00 AM PDT

It's more than politics for several Parti Rakyat Sarawak leaders who've been found to have a finger in land deals in Sri Aman

Eleven longhouse chiefs representing their own 'anembiaks' (followers) have filed a suit against three companies, one owned by members of Parti Rakyat Sarawak (PRS).

The companies have allegedly encroached into their native customary rights land. The PRS president is James Masing, who is also the Land Development Minister.

The suit was filed last month by Messrs Baru Bian and Advocates at the Kuching High Court.

Named in the suit is Kriscore Sdn Bhd whose directors include Kristopher Nyuak Anak Bajok and Jessie Anak Hillary Chukan, both of them are members of PRS, and Razali Zainuddin.

The area licensed to Kriscore Sdn Bhd is about 3,281 hectares and is situated at Ulu Kesit, Lubok Antu.

Also being sued are YWP Industries Sdn Bhd, Pembinaan Suries Sdn Bhd, the Director of Forests, Superintendent of Lands and Surveys, Sri Aman and the Sarawak government.

Pembinaan Suries Sdn Bhd is licensed to extract timber on 850 hectares adjacent to the area given to Kriscore Sdn Bhd.
In their statements of claim, the natives want the court to declare that they had acquired and or inherited native title and native customary rights (NCR) over the area.

They want a declaration that this native title and rights preclude Pembinaan Suries Sdn Bhd (second defendant) and Kriscore Sdn Bhd (third defendant) from issuing or granting the said timber licences thereby impairing or abridging their native rights.

Govt breached Forests Ordinance

They also want a declaration that the acts of the director of Forest (fourth defendant) and the Superintendent of Lands and surveys, Sri Aman (fifth defendant) in issuing the said timber licences, in so far as they impair the natives' NCR over their pemakai menua or ancestral or NCR land, is wrong, illegal, unlawful, bad and void.

The landowners also want a declaration order that the issuance of the said timber licences to the Pembinaan Sdn Bhd and Kriscore Sdn Bhd overlaps or covers their pemakai menua, ancestral, or NCR land and as such is unlawful, improper, unconstitutional and therefore null and void.

They are also seeking an alternatively declaration that the issuance of the said timber licences is subject to the native title or native customary rights or usufructuary rights of the natives in or over the pemakai menua, or ancestral or NCR land.

They want the court to declare that in issuing and granting the timber licences, the Director of Forests and the Superintendent of Lands and Surveys, Sri Aman are in breach of their fiduciary duty to the natives and therefore the said timber licences were null and void.

They said the Director of Forests and the Superintendent of Land and Surveys, Sri Aman are in breach of the statutory provisions of the Forests Ordinance (Cap.126).

The natives want their NCR land be excised out of the area under the said timber licences and want a mandatory injunction against YWP industries Sdn Bhd (first defendant), Pembinaan Suries Sdn Bhd (second defendant) and Kriscore Sdn Bhd (third defendant) their contractors, subcontractors, employees, servants and workers from trespassing, clearing, using or occupying the plaintiffs pemakai menua.

They also claimed damages, exemplary damages, alternatively, aggravated damages, interests and costs.

The contested area is under state constituency of Batang Ai which is part of the Lubok Antu parliamentary constituency. The incumbent assemblyman of Batang Ai is Malcolm Mussen and the MP is William Nyalau, both are PRS senior leaders.

Pesta Benak / River Surfing in Sri Aman Sarawak, East Malaysia

Posted: 28 Feb 2012 06:04 AM PST

Would you dare to be on a surfing board and battle a tidal bore in Sarawak's Batang Lupar, famed for its crocodile-infested waters? Dare-devils should look no further then Sri Aman, 170km from Kuching. The tidal bore here, or "benak", could be a big tourism draw in which it could be known as a fantastic extreme sport.
So far only one man has dared to take up the challenge in battling the benak. He is Frenchman Antony Colas, a hardcore tidal surfer and author of the World Stormrider Guide, a guide book on the best new surfing locations worlwide.

This year, the event will be held on 6-8 April 2012 and you will seeing more action and hopefully we will seeing one of our own Malaysian surfer riding the waves in the river.

Sarawak ministers in RM70mil kickback allegation « Hornbill ...

Posted: 07 Mar 2012 10:21 PM PST

While the furore against Sarawak agriculture assistant minister Mong Dagang's instruction to cease welfare assistance to a disabled person is still boiling, whistleblower website Sarawak Report has raised another shocking allegation.

The website claims that Mong (left) and his party president James Masing are involved in RM70 million kickback from a land development scheme in Mong's constituency.

The allegation is based on a letter purportedly written by Mong on June 18, 1997, as the state assemblyperson of Bukit Begunan to Kho Chee Pheng of Megaruma Sdn Bhd, a company based in Kuching, asking for the kickback.

NONEIn the letter, first exposed in 2010 by a blogger, Mong allegedly authorised Kho to "propose, organise and invite any potential investor(s) intending to establish and to develop on a joint venture basis with the landowners of oil palm plantation in the Kelingkang Range, (Bukit Begunan), Sri Aman, Sarawak".

"I the undersigned hereby agree that the investor(s) will have to pay at least RM1,000 per acre and after deduction of the upfront to LCDA the balance will be divided 50 percent to the undersigned and 50 percent to Kho Chee Pheng," stated the letter.

The Land Custody and Development Authority (LCDA) is a state-owned statutory body to facilitate land development in Sarawak, especially native land.

Wives, brother, own nominee firm

The letter named three companies one of which was to be used for the joint venture, as well as three nominees to be registered with the company chosen for the enterprise.

The companies named are Noble Reserves Sdn Bhd, Noble Resources Sdn Bhd and Noble Rewards Sdn Bhd while the nominees are Bawang Ak Dem, Leyta Kupa and Henry Yan Masing.

james masing and parti rakyat sarawak prs logo launch 160107James (centre in photo) is also Sarawak Senior Minister for Land Development and president of PRS.

The Sarawak Report claimed that Bawang is Mong's wife, Leyta is the wife of James' private secretary Wilson Ugak, and Henry is James' brother.

The website also published a document from the Companies Commission of Malaysia, showing the three nominees as major shareholders of Noble Reserves Sdn Bhd, one of the firms listed in the letter.

Should the payment of RM1,000 per acre come about, the total commission may go up to RM70 million as the letter stated that the plantation area was "approximately 70,000 acres" with investors having to pay "at least RM1,000 per acre".

Although the letter cannot be verified, Mong's purported signature on the letter is similar to the one shown on the letter to the Agriculture Department terminatingsubsidies to the disabled person, which Mong had admitted.

PKR Batu Lintang assemblyperson and native rights lawyer See Chee How told Malaysiakini that native landowners at the area, who had rejected the plantation scheme, are in the midst of bringing the case against the joint venture partners and LCDA to court.

The project was earlier pushed through by James and Mong on the basis that the local people would benefit, said See.

The Sarawak Report also quoted See as saying that both James and Mong had committed fraud because the duo had been trying to convince the people that they would be able to take a 30 percent share of the joint venture and share the profits in return for their land, but they were not told about the huge kickback.

"Under the joint venture that money should have been shared among the people, not paid to nominees of the very politicians who were talking them into the scheme," See added.

Both James and Mong were unavailable for comment at press time

MACC report against Masing and Mong | MoCS

Posted: 09 Mar 2012 03:18 AM PST

By Joseph Tawie

KUCHING: The Sarawak PKR women's wing has lodged a report with the Malaysian Anti-Corruption Commission (MACC) against State Land Development Minister James Masing and State Assistant Agriculture Minister Mong Dagang for alleged misuse and abuse of power in a land deal in Sri Aman.

Masing is Parti Rakyat Sarawak (PRS) president while Dagang is a vice-president. Dagang is Bukit Begunan assemblyman.

Yesterday, a women's wing chief Nurhanim Mokshen handed over some documents, letters and reports in relation to the alleged land deal.

She called on MACC to investigate the allegation to take necessary actions to clear the names of the minister and the assistant minister or to commence the process of cleaning up "our public offices".

She was accompanied by a lawyer, Simon Siah.

The MACC told them that the commission was aware of the case and had been instructed to look into the matter.

Nurhanim's report was in response to online exposé by investigative portal Sarawak Report. The portal published a letter, allegedly signed by Dagang, asking for "kickbacks" amounting to RM70 million from the sale of 70,000 acres of land belonging to his own constituents.

The land at Kelingkang Range, Bukit Begunan, Sri Aman, was to be developed into an oil palm plantation.

Masing, Dagang's 'nominees'

In a letter dated June 18, 1997, Dagang allegedly asked for RM1,000 per acre from Megarume Sdn Bhd.

The letter also "directed" that "any of the three companies – Noble Reserves Sdn Bhd, Noble Resources Sdn Bhd or Noble Rewards Sdn Bhd – to be used for the joint venture with the "investors".

Dagang had also allegedly included details of his name and personal details and "also three photocopies of our nominees' identity cards".

The "nominees" listed in the letter were Dagang's wife, Bawang Ak Deru, Masing's personal secretary's wife, Leyta Kupa and Masing's brother Henry Yan.

All the three are directors of Noble Rewards.

The claim of alleged "kickbacks" came to light following a revelation that Dagang had revoked government welfare aid and subsidies to a disabled farmer simply because he had openly supported the opposition in last April's state election.

Masing's defence of Dagang merely added more fuel to the controversy, with Sarawakians angered over the former's advice to voters to "jangan lawan towkay" (alluding that they – Masing and Dagang –were the bosses and their decisions should not be challenged.

Case in court

Meanwhile, when contacted, native customary rights (NCR) land lawyer See Chee How confirmed that the area in question was already subject to a court case initiated by native landowners.

See, who is also the Batu Lintang assemblyman, said that more than 50% of the landowners had rejected the plantation and many had also turned down the paltry RM1,000 per family offered by these politicians.

Nevertheless, Masing and Dagang have as pushed through the project on the basis that the local people would benefit.

"It surely comes as a surprise that the native landowners are yet to receive any dividends from the enterprise after the first six years.

"This qualifies as fraud," See said, adding this is because Dagang and Masing had been trying to convince people they would be able to take a 30% share of the joint venture and share the profits in return for their land.

"They tell the people 'let the LCDA [Land Custody and Development Authority] develop your land and you will get 30% of the joint venture and profit. However, the people were not told about this huge kickbacks, " he said.

"Under the joint venture, the money should have been shared among the people, not paid to nominees of the very politicians who were talking them into the scheme," See said. – FMT

DEPRAVED DATUKS – New Shocking Evidence Against Mong ...

Posted: 07 Mar 2012 04:24 PM PST

http://www.sarawakreport.org/site/wp-content/uploads/2012/03/Mong.jpg

Sarawak Report

The BN Agriculture Minister, Mong Dagang, who demanded that a disabled man be deprived of his RM300 a month support and the PRS leader, James Masing, who supported his action, have both been caught seeking illegal kickbacks for themselves in a joint venture worth tens of millions!

They were making the money out of NCR land defrauded from their own constituents in the same area!

Ultimate depravity

No incident better sums up the shocking depravity of Taib Mahmud's regime in Sarawak than the appalling meanness and greed, as well as extraordinary arrogance, that has now been exposed in these two key Ministers as a result of this disgusting affair.

The story began to unravel at the start of this week when disabled farmer, Frusis Lebi, at last discovered why his meagre allowance of RM300 a month had suddenly been stopped.

Frusis Lebi clutches Mong Dagang's heartless letter with one of his two deformed hands

The money was an allocation in recognition of his deformed hands and feet, which makes it an extraordinary burden to try to scrape a living.

Embarrassed officials had finally told Frusis that the reason was that his own Sri Aman MP, Agriculture Minister Mong Dagang, had actually written a letter on headed official paper commanding them to cut off his allowance, because he had supported the opposition in the election!

They gave him a copy of the letter, which told officials to end "all forms of government assistance" to Fusis, who was identified as a disabled person by Mong Dagang. The Minister explained his outrageous reason thus:

"This is because he has gone against government policies and openly supported the opposition candidate in the 2011 state election," [story broken in Malaysiakini]

Arrogance

Shocked onlookers, who could scarcely believe this letter could be true, waited for Dagang to deny the document and claim forgery. Instead, however, the Minister not only admitted he had written it, but he sought to justify his actions!

"As a man of principle, I am not going to back out," the depraved Mong declared. "We cannot continue to give welfare assistance and subsidies because he is a strong opposition supporter!"

Signed!

What kind of sham democracy does this man think he is part of in Sarawak, that he does not even bother to pretend that BN doesn't victimise those who seek to exercise their basic rights to vote for whom they like?

Given up pretending? Masing makes clear that BN don't win elections, they steal them.

And what kind of petty arrogance is in such a man, that he wishes to take such revenge on a disabled person?

And finally, how stupid can he be that he does not realise how he can only alienate more voters by such appalling and disgusting acts of intimidation?

Even more astonishing was the next development. None other than James Masing, one of Taib's top Ministerial allies and President of the supposed Dayak party PRS, came out in support of Mong Dangang too!

This Minister for Land Development went on record to tick off Mr Lebit by announcing " jangan lawan towkay" [don't fight the bosses]!

Masing smugly elaborated:

"in any organisation, including political parties, we cannot go against our boss. That is the golden rule in life which we must observe".

Mr Masing who benefitted from an Australian university education (through which he was largely assisted by his then wife) is clearly in need of a basic political re-education. It is the people who are the boss and he has been elected to SERVE them.

No help for this man from the multi-millionaire Depraved Datuks

His threats against voters for the opposition are an open admission that BN do not win elections in Sarawak, they steal them by cheating, intimidation, bribing and rigging.

And today, it has been reported that this threatening intimidation and abuse of power has just been stepped up even further in this case, as the police were dragged into the matter and instructed to arrest Frusis Lebi and harass him further.

Lebi, whose painful deformities are plain to see, says that the police wanted to know which official had released the copy of Mong Dagang's letter to him!

No guesses as to who is wanting to know that and why.

However, Mr Dagang should stop bothering to persecute whoever spilled the beans, because now a far more damaging letter, also written by him, has come into the open.

Fraudsters in a criminal regime – Fresh Expose!

Thanks to the new information and our further research, Sarawak Report can now expose just why it was that James Masing was so quick to come to the defence of Mong Dagang yesterday. It is because the two men are also joined in a fraudulent enterprise to make money out of their constituents' lands.

Their company Noble Rewards Sdn Bhd has been taking kickbacks from the sale of plantation territories in Sri Aman.

Ignoble Rewards! - The benefactors of the kickbacks demanded for these lands are Mong Dagong's wife, James Masing's brother and the wife of Masings Private Secretary

The proof of the scam comes in yet another letter signed by Mong Dagang. Indeed Mong Dagang's predilection for signing letters written on headed paper has been an abiding characteristic of this scandal, making his arrogance a large part of his undoing.

The second "Private and Confidential" letter came to light today and, as the signature is now familiar to us all, Mong Dagang will be hard-put to deny it this time! In the letter Dagang makes clear that he is seeking kickbacks from participants in a land development scheme.

The 70,000 acres in question came from NCR landowners in his own constituency!

"The balance will be paid 50% to the undersigned" through "our nominees"!

This is the text of the damning secret letter signed by Mong Dagang:

"DEWAN UNDANGAN NEGERI SARAWAK

AHLI DEWAN UNDANGAN NEGERI N.22 BUKIT BEGUNAN

Kickback is worth at least RM 70 million !

Trust me to earn a packet out of your timber and your lands. Mong Dagang has exploited his people.

The kickback referred to in this letter by Dangang adds up to at least RM 70 million!

He is demanding "at least" RM1,000 per acre of the 70,000 acres of land that is being developed into plantations, minus whatever paltry premium was requested by the Land Custody and Development Authority (LCDA), which is itself controlled by this band of political conspirators!

Our company research (above) has now confirmed that the main shareholders of the company Noble Rewards Sdn Bhd, to be used for the 'joint venture' proposed in this crooked scheme are Bawang Anak Deru, Mong Dagang's own wife; Henry Masing, James Masing's brother and Leyta Kupa, wife of James Masing's private secretary Wilson Ugak.

Sarawak Report asks what right does Mong Dagang think he has "as an elected representative of my area" to "authorise such a kickback fraud?

And how can he have been so blatantly and stupidly arrogant as to demand that it is then paid to his own nominees in this letter written in 1997?
